WebDash is a B2B SaaS platform that enables businesses to create, customize, and manage websites using artificial intelligence technology. Our Services include AI-driven website generation, content creation, design customization, hosting through WordPress, and ongoing website management tools.

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, do not access or use our Services.

**Account Registration:** To use our Services, you must create a business account and provide accurate, current, and complete information about your business and authorized representatives.

**Business Accounts:** Our Services are designed for business use. You represent that you have the authority to bind your organization to these Terms and that your use complies with your organization's policies.

**Account Security:** You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized access or security breaches.

**Account Suspension:** We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or pose security risks to our platform or other users.

**Multiple Users:** Business accounts may have multiple authorized users. The account holder is responsible for all user activities and ensuring compliance with these Terms.

**AI-Powered Features:** Our platform uses artificial intelligence, powered by OpenAI, to generate website content, design suggestions, and customization recommendations based on your inputs and preferences.

**Website Creation:** You can create multiple websites using our AI tools, with content, design, and functionality tailored to your business needs and specifications.

**Hosting & Deployment:** Websites created on our platform are hosted and deployed through WordPress, providing reliable and scalable hosting solutions.

**Data Storage:** Your website configurations, content, and user data are securely stored using Firebase and local storage technologies to ensure proper functionality.

**Service Availability:** We strive to maintain high availability but cannot guarantee uninterrupted service. Scheduled maintenance will be communicated in advance when possible.

**AI Limitations:** While our AI tools are advanced, generated content may require review and editing. You are responsible for ensuring all content meets your standards and legal requirements.

**Subscription Plans:** We offer various subscription tiers with different features, usage limits, and pricing. Current plans and pricing are available on our website.

**Payment Processing:** All payments are processed securely through Stripe. By subscribing, you authorize Stripe to charge your payment method for recurring subscription fees.

**Automatic Renewal:** Subscriptions automatically renew at the end of each billing period unless canceled before the renewal date through your account settings.

**Fee Changes:** We may modify subscription fees with advance notice. Existing subscriptions continue at current rates until the next renewal period.

**Cancellation:** You can cancel your subscription at any time through your account dashboard. Cancellation takes effect at the end of your current billing period.

**Usage Limits:** Each subscription plan includes specific usage limits. Exceeding limits may result in additional charges or service restrictions.

**Content Responsibility:** You are solely responsible for all content created, uploaded, or published using our Services, including ensuring it does not infringe on third-party rights.

**AI Content Review:** Review and verify all AI-generated content before publication. We are not responsible for the accuracy, completeness, or appropriateness of AI-generated content.

**Resource Usage:** Use platform resources reasonably and avoid activities that could degrade service performance for other users.

**Compliance:** Ensure your websites and content comply with applicable laws, industry regulations, and third-party service terms (including those of WordPress for hosting).

You agree not to:

**Illegal Content:** Create, upload, or distribute illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable content.

**Intellectual Property Violations:** Use our Services to infringe on copyrights, trademarks, or other intellectual property rights of third parties.

**System Interference:** Attempt to hack, reverse engineer, or interfere with our platform, infrastructure, or security measures.

**Spam and Abuse:** Use our Services for spam, phishing, malware distribution, or other abusive practices.

**Unauthorized Access:** Access or attempt to access accounts, systems, or data belonging to other users or unauthorized areas of our platform.

**Commercial Misuse:** Resell, redistribute, or sublicense our Services without explicit written permission.

**Data Mining:** Use automated tools to scrape, mine, or harvest data from our platform or other users' websites.

**False Information:** Provide false, misleading, or fraudulent information during registration or use of our Services.

**Your Content:** You retain ownership of content you create, upload, or generate using our Services. You grant us a limited license to use, store, and display your content solely to provide our Services.

**Our Platform:** WebDash retains all rights to our platform, software, AI models, algorithms, and proprietary technology. These Terms do not grant you any ownership rights in our intellectual property.

**AI-Generated Content:** Content generated by our AI tools becomes your property, subject to our Terms and any applicable third-party terms (such as OpenAI's usage policies).

**Third-Party Rights:** Respect third-party intellectual property rights when using our Services. We will respond to valid copyright infringement notices in accordance with applicable law.

**License to Use:** We grant you a limited, non-exclusive, non-transferable license to use our Services in accordance with these Terms during your subscription period.

**Data Collection:** We collect and process data as described in our Privacy Policy, including usage analytics through PostHog and website data stored via Firebase.

**AI Data Processing:** Your interactions with our AI features may be processed by OpenAI's services. Review OpenAI's terms and privacy policy for additional information.

**Data Security:** We implement appropriate security measures to protect your data, including encryption, access controls, and regular security audits.

**Data Portability:** You can export your website data and content at any time through your account dashboard.

**Third-Party Services:** Our use of third-party services (Stripe, AWS, N8N, Mailgun, WordPress, PostHog) is governed by their respective terms and privacy policies.

**Data Retention:** We retain your data as described in our Privacy Policy and as necessary to provide ongoing Services.

**Availability:** We aim to maintain high service availability but do not guarantee uninterrupted access. Scheduled maintenance will be announced in advance when possible.

**Support:** We provide customer support through our designated channels. Support response times vary by subscription tier and issue severity.

**Updates & Maintenance:** We regularly update our platform with new features, security patches, and performance improvements. Some updates may temporarily affect service availability.

**Infrastructure:** Our Services rely on third-party infrastructure providers (AWS, WordPress) whose availability may impact our Services.

**Performance:** While we optimize for performance, website speed and availability depend on various factors including hosting infrastructure and content complexity.

**Backup & Recovery:** We maintain regular backups, but you are encouraged to maintain your own copies of important content and data.

**Service Disclaimer:** Our Services are provided "as is" without warranties of any kind. We do not guarantee that our Services will meet your specific requirements or be error-free.

**AI Limitations:** AI-generated content may contain errors, inaccuracies, or inappropriate material. You are responsible for reviewing and verifying all AI-generated content before use.

**Third-Party Services:** We are not responsible for the performance, availability, or policies of third-party services we integrate with (Stripe, OpenAI, WordPress, etc.).

**Limitation of Liability:** Our liability to you is limited to the amount you paid for Services in the 12 months preceding the claim, except where prohibited by law.

**Business Risks:** You acknowledge that using our Services involves inherent business risks, and we are not responsible for business losses or decisions based on our Services.

**Force Majeure:** We are not liable for service interruptions caused by events beyond our reasonable control, including natural disasters, pandemics, or infrastructure failures.

**Termination by You:** You may terminate your account at any time by emailing our support team.

**Termination by Us:** We may suspend or terminate your account for violations of these Terms, non-payment, or other legitimate business reasons with appropriate notice.

**Effect of Termination:** Upon termination, your access to our Services will cease, but your websites may continue to be hosted through WordPress subject to their terms.

**Data Retention:** After termination, we will retain your data for a reasonable period to allow for account reactivation, then delete it in accordance with our Privacy Policy.

**Survival:** Certain provisions of these Terms (including payment obligations, intellectual property rights, and liability limitations) survive termination.

**Updates:** We may update these Terms to reflect changes in our Services, legal requirements, or business practices.

**Notification:** We will notify you of material changes via email or platform notifications at least 30 days before they take effect.

**Acceptance:** Continued use of our Services after changes indicates acceptance of the updated Terms. If you disagree with changes, you may terminate your account.
